Cabeceiras.pt is the owner of this website and, unless expressly stated otherwise, of all its contents, which are protected by national and international intellectual property laws. By accessing and using this site, the user accepts the terms and conditions that govern its operation and are defined below.

The Client and the User must comply with and respect these general conditions. They undertake, in particular, to comply with the following obligations:

1) It is forbidden to introduce, store or disseminate through the website defamatory, obscene, injurious, xenophobic and/or any other content that violates general legal principles and public order;

2) Keep, and not disclose, your login password to the website in order to prevent third parties from accessing your account at Cabeceiras.pt;

3) Not to use false identities;

4) To provide correct personal data and addresses so that Cabeceiras.pt can duly process orders;

The Client is responsible for the veracity of the data communicated to Cabeceiras.pt and undertakes to immediately update any changes to them in their Registration Account.

Cabeceiras.pt disclaims any responsibility for any delay or impossibility of processing the order, namely at the time of delivery, resulting from error or insufficiency of the data communicated by the Client.

 

The data collected on this website is intended for processing orders and communicating with Clients, processing information requests and any complaints, statistical analysis, as well as its respective use for direct marketing purposes.

 

Cabeceiras.pt guarantees the confidentiality of all data provided by its customers. Although Cabeceiras.pt collects and processes data securely and in a way that prevents its loss or manipulation, using the most advanced techniques for this purpose, we inform you that collection over an open network allows personal data to circulate without security conditions, risking being seen and used by unauthorized third parties.

 

All Clients have the right to access, rectify, cancel and oppose their data. If you wish, at any time, to no longer be part of the Cabeceiras.pt database, you can exercise this right by simply contacting us.

 

The client expressly authorizes Cabeceiras.pt to send information about products and services that may be of interest to them using their personal data for direct marketing purposes through any communication channel, namely by using email, SMS, MMS or other forms of automatic calling. Cabeceiras.pt will not sell or share its customer database with third parties.

 

The validation of the purchase order implies that the Client has read and accepted the General Conditions of the website. The data registered by Cabeceiras.pt constitute proof of the set of transactions carried out between Cabeceiras.pt and the Client. It is the responsibility of Cabeceiras.pt to archive the electronic document in which the contract is formalized and keep it accessible.

As soon as you complete your purchase, you will receive an automatic email confirming the transaction. If the data is not correct, you can immediately request its alteration, or even, the cancellation of the purchase made.

 

Cabeceiras.pt only processes an order placed by a customer after confirmation of the respective payment, so Cabeceiras.pt cannot guarantee the availability of the items until the start of said processing. On the product page you will find the estimated shipping date or you can contact us to request such information.

The estimated shipping time is in addition to the transport time and the destination of your order.

 

Cabeceiras.pt only ships on business days or, if agreed, on Saturdays. Thus, neither weekends nor holidays are counted for estimated order delivery, with exceptions.

 

Collection at facilities

Any order can be collected at our facilities available for this purpose without any additional cost.

The customer is informed by email or phone contact as soon as they can make their collection. Products can be collected up to 5 working days after notification.

For collection, you must go to the Cabeceiras.pt facilities, presenting proof of your order.

In any case, the estimated delivery dates are merely indicative.

Any delay in the dispatch of items, compared to the estimated dates presented, does not confer the right to compensation.

 

Failure to pay for the order within 10 (ten) days subsequent to the date on which it was placed implies its automatic cancellation.

In case of product unavailability and/or stockout, you will be informed of the partial or total cancellation of your order with the right to reimbursement of the respective amount paid.

In accordance with the provisions of Law 7/2004 of January 7, relating to electronic commerce, Cabeceiras.pt reserves the right to unilaterally cancel the order whenever there is a programming error, a malfunction of Cabeceiras.pt's computers or if the contractual proposal arrives deformed at its destination and the error concerns an essential element of the contract.

 

RETURNS

In order to offer the best possible product, at Cabeceiras.pt we do not work with product stock. All products are made to order, especially for each client.

Therefore, according to the current legislation for distance purchases, the 14-day reflection period for returns does not apply. This policy follows the exemption applied to products manufactured to order and/or personalized, as well as to products damaged by misuse, wear, or client negligence.

We recommend that you always check the condition of your products upon receiving them. If you detect any anomaly, please photograph the damage and inform us immediately through our online contact form or the contacts available on this site. Only then can we accept complaints regarding damages caused during delivery/assembly.

 

DEFECTIVE PRODUCTS OR ANOMALIES

If the purchased product has a defect or anomaly, the customer should contact our customer support service as soon as possible for guidance on the exchange, repair or refund procedure, in accordance with applicable law.

You have 14 days from the delivery date of the order. The product(s) must be without signs of use.



RETURN/EXCHANGE/REPAIR PROCEDURE

To request a return/exchange/repair, the customer must follow these steps:

b) Provide the order number, customer name, email/phone associated with the purchase, and the reason for the request;

c) Await instructions from our team regarding the procedure for collecting the product(s).

d) The return must be made within 14 days after it was requested.



REFUNDS

After we receive the returned item and verify that it is in perfect condition, we will proceed with the refund of the amount paid by the customer. The refund will be made using the same payment method used for the purchase, unless there is a technical impediment. The refund process can take up to 14 working days from the date we receive the return, varying according to the payment method used and the customer's bank. We will do our best to ensure that the process is as fast and efficient as possible.



EMMA BRAND PRODUCTS

All EMMA products come with a 100-night trial, and if it doesn't suit you, you can request a free pickup and receive a refund. The trial period begins on the day you receive the mattress at your home.

All purchases made on the website are subject to Portuguese law. Any conflict or divergence in the interpretation of the General Conditions will be submitted to the competent Portuguese Court.

WARRANTY:

All products sold by Cabeceiras.pt (except Emma brand - specific conditions apply) have a valid warranty for the legal period of three (3) years, counted from the date of product delivery and upon presentation of the purchase invoice. Products that have been improperly used or incorrectly handled/applied by the customer are excluded from the scope of the warranty.

 

Gift Cards

1 General Information
These Terms and Conditions apply to Cabeceiras.pt gift cards purchased in our online store. The purchase and use of a Cabeceiras.pt Gift Card implies the acceptance of these Terms and Conditions ("Terms and Conditions"). Cabeceiras.pt reserves the right to interpret, modify or terminate the Terms and Conditions without prior notice. The latest Terms and Conditions will always be published on Cabeceiras.pt.

The Cabeceiras.pt Gift Card can be used in Cabeceiras.pt stores and in the online store at www.cabeceiras.pt. You can use the Cabeceiras.pt Gift Card to pay for the total value or part of the value of the selected item(s). If your online purchase is not fully covered by the Cabeceiras.pt Gift Card, you can use an additional payment method to complete the purchase, by the available means.

2 Validity
Each purchase of the Cabeceiras.pt Gift Card is limited to a maximum value of €500 and a minimum value of €25.

The Cabeceiras.pt Gift Card can be used until the card balance is zero. After the card balance is zero, the card becomes invalid.

Cabeceiras.pt Gift Cards are valid for 12 months after the purchase date. After the expiration of the validity period, Cabeceiras.pt Gift Cards cannot be used for purchases or reactivated, and any unused remaining value cannot be refunded.

3 Returns

The return policy is governed by the Cabeceiras.pt usage and return rules published on the website www.cabeceiras.pt.

You must provide a correct email address for sending the Cabeceiras.pt Gift Card.

Cabeceiras.pt Gift Cards cannot be exchanged for cash.

4 Limited Liability
Cabeceiras.pt cannot be held responsible for Cabeceiras.pt Gift Cards that, after activation, are stolen, lost, deactivated or damaged. Treat your Cabeceiras.pt Gift Card as if it were cash.

5 Privacy Policy
The customer is responsible for all personal data they provide to Cabeceiras.pt. For this reason, Cabeceiras.pt has a Privacy Policy that establishes how your personal data will be processed and protected. You will find our Privacy Policy on the website www.cabeceiras.pt.
